PRIVACY NOTICE FOR VIDEO SURVEILLANCE (CCTV)

1.     Lawful Basis and Legitimate Purpose

Solidigm operates video surveillance systems at certain Solidigm facilities for the security and safety of persons and property, crime prevention and detection, access control, and other legitimate business purposes.

2.     Data Collected

Video surveillance systems collects video images of individuals in monitored areas.  Solidigm does not collect biometric data or use facial recognition technology in connection with its video surveillance systems. 

The video surveillance does not have voice or audio capabilities.  No voice or audio is being collected or recorded.

3.     Areas under Video Surveillance

Solidigm operates video surveillance systems in strategic locations in most of its facilities.  This footage constitutes “electronic, visual, or similar information” under applicable privacy law.

Cameras are installed at the main point of entry to Solidigm offices, and the following points of entry or exit:

a.     Doors that are not the main point of entry, such as side doors

b.     Laboratories

c.      Storage facilities

d.     Shipping and receiving areas

e.     High traffic pathways

f.      IT rooms

Solidigm does not install or operate video surveillance in areas where there is a reasonable expectation of privacy, such as restrooms/lavatories or changing rooms.

4.     Selling or Sharing of Video Surveillance Footage

Solidigm does not sell or share any video surveillance footage.

5.     Data Controller

The controller of video surveillance data is Solidigm.

6.     Retention Period

Video surveillance recordings are stored for a period of 90 days, after which they are automatically overwritten.  If footage is required as evidence in legal proceedings, law enforcement requests, or internal investigations, it may be stored for longer than 90 days. 

Access to video surveillance recordings is restricted to authorized security personnel and may be disclosed to law enforcement upon valid legal process.

8.     Specific Information based on Geographic Location

a.     Notice to Individuals in the United States

Depending on your state of residence, you may have the right to know what personal information is collected and how it is used, access your recorded images, and request deletion of your recorded images.  To exercise these rights, see Section 9.

For California residents, the following Notice at Collection applies pursuant to Cal. Civ. Code § 1798.100: Solidigm collects electronic, visual, or similar information (video footage) for the purposes of security and safety of persons and property, crime prevention and detection, and access control.  Solidigm does not sell or share your personal information, including video recordings, as defined by the CCPA/CPRA. 

b.     Notice to Individuals in Canada 

The collection and handling of personal information through Solidigm’s video surveillance systems is governed by the Personal Information Protection and Electronic Documents Act (PIPEDA), S.C. 2000, c. 5, or applicable provincial legislation.  You have the right to access video images of yourself held by Solidigm.  To make an access request or to ask questions about this surveillance system, see Section 9.  You may also file a complaint with the Office of the Privacy Commissioner of Canada, 30 Victoria Street, Gatineau, QC K1A 1H3, 1-800-282-1376, priv.gc.ca, or with the applicable provincial commissioner.

c.      Notice to Individuals in Mexico

CCTV images are personal data under Ley Federal de Protección de Datos Personales en Posesión de los Particulares (Federal Law on the Protection of Personal Data Held by Private Parties) (LFPDPPP).  To limit the use or disclosure of your personal data, see Section 9.  To see Solidigm’s Privacy Notice, including the mechanisms for exercising your ARCO (Access, Rectification, Cancellation, and Opposition) rights, please see Section 7.  Complaints may be directed to the Secretaría Anticorrupción y Buen Gobierno.

d.     Notice to Individuals in China 

Per the Personal Information Protection Law (PIPL) Art. 26, collected images are used solely as described in Section 1 and will not be used for other purposes without separate individual consent.  To exercise your right to access, copy, correct, and delete your personal data, to withdraw consent, to request an explanation of processing rules, and to object to processing, see Section 9.  Complaints may be directed to the Cyberspace Administration of China (CAC) or your local public security bureau.

e.     Notice to Individuals in Taiwan

Solidigm’s video surveillance is in accordance with the Personal Data Protection Act (PDPA).  This surveillance system passively collects image data.  You are not required to actively provide personal data.  If you do not wish to be recorded, please do not enter the monitored area.  To exercise your right to access, copy, correct, and delete your personal data, and to request cessation of collection, processing, or use, see Section 9.

f.      Notice to Individuals in Poland

Solidigm operates video surveillance under Art. 6(1)(f) of the GDPR (legitimate interest of the controller: security of persons and property protection) and for workplace monitoring, under Art. 222 of the Polish Labour Code.  Recordings are stored for up to 90 days as permitted under Art. 222 §3 of the Labour Code, as described in Section 6 above.  To exercise your right to access recordings, request erasure, restrict processing, object to processing, and data portability, see Section 9.  You also have the right to lodge a complaint with the Prezes Urzędu Ochrony Danych Osobowych (UODO), ul. Stawki 2, 00-193 Warszawa, uodo.gov.pl.
