About this Notice
This General Privacy Notice (“Privacy Notice”) provides details on how Solidigm, located at 10951 White Rock Road, Rancho Cordova, CA 95670 (“Solidigm,” “we,” “us,” or “our”), when a data controller, may collect, process, and use your Personal Information, also referred to as “PI”. For purposes of this Privacy Notice, Solidigm uses “Personal Information” and “PI” interchangeably.
For purposes of this Privacy Notice, “Personal Information” or “PI” means any information that identifies, relates to, or could reasonably be linked to an identifiable natural person. This Privacy Notice applies to PI collected by Solidigm, that you share with Solidigm, or collected through our website, other applications (including mobile applications), and other digital interactions we may have with you (collectively referred to as “Solidigm Services”).
This Privacy Notice updates Solidigm’s prior privacy notice to reflect changes that Solidigm made since our last Privacy Notice dated January 2025. This version supersedes all prior versions.

Categories of Information Collected by Solidigm
Solidigm may collect PI as part of its business operations, to offer and provide products and services, to respond to requests and offer customer support, to fulfill legal and contractual obligations and to create and build its products. Also, you may provide PI to Solidigm, such as when you order a Solidigm product, contact customer support, or register for an event or publication. Solidigm also collects information through your interactions with any Solidigm Services and our website. We also may collect PI from third parties.
Solidigm may also, from time to time, engage in research, analysis, historical and scientific studies (either alone or with third party business collaborators), or marketing and communications activities. As part of such efforts, Solidigm may invite individuals to participate.
If an individual agrees to participate, Solidigm will tell the individual the purpose of our processing activities and obtain the individual’s consent prior to their participation. In some cases, Solidigm may rely on legitimate interest to engage in these studies. When Solidigm receives PI from a third party for the purpose of such research, we undertake processes to validate that the PI has been collected in a responsible and lawful manner.
If you submit any PI about other people to us or to our service providers, you are responsible for making sure that you have the authority to do so and to allow us to use their PI in accordance with this Privacy Notice.
In addition, computing devices used by Solidigm may include embedded technology, such as processing chips, which collect information about how the device is operating. This information may include:
Access to this information by other applications and transmission of this information from a device to Solidigm or other service providers may be controlled by the operating system or other software running on the device.
In some instances, Solidigm technology is used within a product or device that may collect PI, which is not shared with Solidigm. This information may be collected by the manufacturer of the product or device, and you will need to read the privacy notice, privacy policy, or related terms published by that manufacturer to understand how they collect and use your information.
Solidigm Services may also collect geographic location information, such as location inferred from your IP address or GPS, and information about how you engage with and use Solidigm Services; for example, where you have chosen to activate location enabled services on the device with which you access these services.
If Solidigm Services use more sensitive categories of your PI, Solidigm will honor the preferences you set in accompanying menus and settings.
Information From the Solidigm Website & Services. Solidigm may collect, process, and use the following three types of PI:
Information Solidigm Automatically Collects: When you access or use the website services, Solidigm may automatically collect certain PI from you, which includes:
Information Collected by Trackers: Solidigm may use data collection tools (here called “cookies” and includes sessions, or similar technologies). You can adjust your cookie choices by clicking “Cookie Settings” on the footer of the Solidigm website.
Children’s Privacy. Solidigm does not knowingly collect or solicit PI from children under the age of 13 [OO1] without verifiable parental consent. If Solidigm becomes aware that a user of the website services under the age 13 has submitted PI to Solidigm without verifiable parental consent, Solidigm will permanently delete that PI. Please contact us at DSRequests@Solidigm.com if you become aware that a child for whom you are the parent or guardian has provided Solidigm with any PI without your consent.
Your Choices and Rights Concerning Your PI. In addition to the rights you might exercise with Solidigm (see below), Solidigm’s business collaborators or third-party services providers may collect your PI through their online tools or through other means. To determine if you have any rights with regard to those business collaborators or third-party services providers, please contact them directly.
Purposes for Collection and Use of Personal Information
Solidigm may collect and use PI for general legal, business, or marketing purposes, for the provision of the website services, for other legitimate business purposes, including those associated with the growth, maintenance, and management of our business. These “Processing Purposes” include our internal operations and administration, communicating with you and fulfilling your requests for Solidigm Services, for advertising and marketing, to monitor and maintain functionality and security of Solidigm Services and to improve, develop, enhance, and otherwise provide Solidigm Services. In addition to the information above, this section describes Solidigm’s practices regarding the PI we collected about California residents in the last 12 months, the sources of that information, our business or commercial purposes for collecting that information, and the third parties with whom we shared that information. Solidigm does not “sell” or “share” your PI as those terms are defined under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA).

Notice to Individuals Covered by Mexico’s Data Privacy Law
Our processing of personal data in Mexico complies with the Federal Law on the Protection of Personal Data Held by Private Parties (“LFPDPPP”). We provide individuals with their full ARCO rights—the rights of Access, Rectification, Cancellation, and Opposition—enabling you to request information about your personal data, correct inaccuracies, request its deletion through a blocking and subsequent removal process, or object to its processing when justified. We process personal data only for the purposes described in this Privacy Notice.
Legal Basis for Our Use
Certain geographic areas of the world require notification of our legal basis for collecting and using PI, including the European Economic Area (EEA), United Kingdom (UK), Mexico, and China.
The following explains our legal bases, including references to the Global Data Protection Regulation (“EU GDPR”), the UK’s adoption of the EU GDPR as well as the adoption by other states within the EEA (collectively “GDPR”), the Personal Information Protection Law (“PIPL”), and the Federal Law on the Protection of Personal Data Held by Private Parties (“LFPDPPP”).
To Communicate and To Direct You to Solidigm-Related Requests:
Contract: to provide products and services, including support, and related information if you or your business is a customer or vendor of Solidigm or if you sign up to receive information or attend an event (Article 6(1)(b) GDPR and Article 9(4) LFPDPPP).
Legitimate Interest: to gather and provide information if you or your business is a customer or potential customer or vendor, including responding to your inquiries (Article 6(1)(f) GDPR).
For Business Operations, For Functionality, Development, and Improvement of Solidigm Services, and For Product Updates and Reporting:
Contract: to provide record, bill for, and receive payment for products and services and other administrative business activities (Article 6(1)(b) GDPR and Article 9(4) LFPDPPP).
Legitimate Interest: to gather and provide information if you or your business is a customer or vendor of Solidigm or a potential customer or vendor, including providing changes and improvements to you, analyze performance, enhancing our products and services, responding to your inquiries, and to carry out regulatory and contractual compliance activities, improving products and services (Article 6(1)(f) GDPR).
For Complying with Laws:
Legal Obligation: to conduct investigations including at the request of a legal authority or as required by a regulatory compliance obligation (Article 6(1)(c) GDPR and Article 9(1) LFPDPPP).
Legitimate Interest: to conduct monitoring in support of corporate oversight and seeking expert advice (Article 6(1)(f) GDPR).
For Technology and Security:
Legal Obligation: to conduct investigations including at the request of a legal authority or as required by a regulatory compliance obligation - (Article 6(1)(c) GDPR)), Article 13(3) and 13(7) PIPL, and Article 9(1) LFPDPPP).
Legitimate Interest: to implement security controls, conduct monitoring in support of corporate oversight, and seeking expert advice (Article 6(1)(f) GDPR).
For Advertising and Marketing:
Contract: to provide information if you or your business is a customer or vendor of Solidigm or you sign up to receive information or attend an event (Article 6(1)(b) GDPR, Article 13(2) PIPL, and Article 9(4) LFPDPPP).
Legitimate Interest: to provide information if your business is a customer or vendor of Solidigm or potential customer or vendor (Article 6(1)(f) GDPR).
Consent: as needed (Article 6(1)(a) GDPR, Article 13(1) PIPL, and Article 7, Paragraph 1 LFPDPPP).
For individuals who are located in China, we may process your PI based on the following applicable lawful bases according to the Personal Information Protection Law:
If we process Special Categories or Sensitive PI, we do so if you give us your explicit consent, the processing is necessary to meet a legal or regulatory obligation, the processing is in connection with the establishment, exercise or defense of our or our client’s legal claims or is otherwise expressly permitted by applicable data protection laws. Special Categories of PI include information about your racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, and data concerning health, sex life, and sexual orientation. Biometric identifiers will only be processed with your consent or if not prohibited by law. Sensitive PI can include information about your precise geolocation, financial data, citizenship, and immigration data. For those protected by China’s PIPL, Solidigm will only collect these sensitive personal information types of PI where there is sufficient necessity to do so.
Who Accesses Personal Information
Solidigm works through our affiliates, authorized suppliers, and business collaborators, to provide some Solidigm Services. Solidigm may share your PI with third parties, including affiliates of Solidigm, for any of the Processing Purposes, as follows:
Records Retention
Solidigm will retain your PI no longer than is necessary to carry out any of the Processing Purposes described in this Privacy Notice, or as otherwise required by applicable law and Solidigm procedures. Where a different retention period is required by applicable law, however, Solidigm reserves the right to extend or alter any of its applicable records retention time periods.
Solidigm will permanently delete your PI when no longer necessary for any of the Processing Purposes or as described immediately above. Solidigm will continue to process (including use, disclose, and store), any retained PI consistent with this Privacy Notice.

Solidigm reserves the right to validate the requestor's identity, including when the request is made by a representative of the data subject. Solidigm also reserves the right to seek additional details to assist in Solidigm’s response and to aid Solidigm in locating the individual’s PI. If Solidigm has a legal right to reject your request, we will provide an explanation for the rejection.
